These Terms of Service (“Terms”) govern your use of the Beautys website and your purchase of products from us.

Beautys is operated by Beautys Trust (“Beautys”, “we”, “us” or “our”). By accessing our website, creating an account, placing an order or purchasing products from Beautys, you agree to these Terms.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other rights that cannot lawfully be excluded.

Using Our Website

Products

We make reasonable efforts to accurately display and describe our products. However, colours and product appearance may vary slightly depending on your screen, lighting, device, photography and manufacturing variations. As many Beautys products are produced in small batches, minor variations between batches may occur. Packaging, labels, bottles or other product presentation may occasionally change without materially changing the product.

Fragrance Products

Fragrance is highly subjective. How a fragrance smells, develops, projects or performs can vary between individuals and may be influenced by skin, temperature, environment, application and other factors. Descriptions of fragrance notes, performance, character or scent profile are intended to assist customers in understanding a product but should not be interpreted as a guarantee that a fragrance will smell or perform identically for every person.

Inspired Fragrances

Some Beautys fragrances may be described as being inspired by particular fragrance styles or well-known fragrances. Where another brand or fragrance is referenced, the reference is intended to help customers understand the general fragrance style or inspiration. Beautys products are independent products sold under the Beautys brand. Unless expressly stated otherwise, Beautys is not affiliated with, endorsed by, sponsored by or associated with the designer brands or trademark owners referenced in connection with an inspired fragrance. Any third-party names and trademarks remain the property of their respective owners.

Prices

All prices displayed on the Beautys website are in Australian dollars (AUD) unless otherwise stated. Prices may change from time to time. The price applicable to your order will generally be the price displayed when your order is placed, subject to correction of genuine errors. Shipping charges, discounts and other applicable amounts will be displayed during checkout where relevant.

Promotions and Discounts

Beautys may offer promotions, bundles, discount codes or special offers from time to time. Promotions may:

Have specified start and end dates
Apply only to selected products
Require a minimum purchase
Exclude certain products
Be limited to one use per customer
Be unavailable in combination with another offer Specific promotional conditions displayed with an offer form part of these Terms. Beautys may withdraw or amend a promotion where reasonably necessary, but this will not affect an order already accepted unless required to correct an error or comply with law.

Orders

Submitting an order does not necessarily mean that we have accepted it. We may decline or cancel an order where reasonably necessary, including where:

A product is unavailable
An incorrect price or product information was displayed
Payment cannot be authorised
We reasonably suspect fraud or unauthorised activity
Delivery cannot reasonably be completed to the supplied address
An obvious technical or system error has occurred
The order breaches purchasing restrictions associated with a promotion If we cancel an order after payment has been successfully received, we will provide an appropriate refund for the cancelled portion.

Payment

You must provide accurate information when placing an order. Payment is processed using the payment methods available at checkout. Payments may be processed by third-party payment providers and are also subject to the relevant provider's terms and privacy practices. You confirm that you are authorised to use the payment method supplied for your purchase.

Shipping and Delivery

Beautys currently ships within Australia. Shipping charges and any applicable free-shipping thresholds will be displayed on our website or during checkout. Delivery estimates are estimates only and can be affected by postal networks, courier delays, weather, public holidays, incorrect addresses and other circumstances outside our reasonable control. We will take reasonable steps to dispatch orders within the timeframes communicated on our website. Additional information about delivery may be contained in our separate Shipping Policy.

Incorrect Delivery Information

Customers are responsible for providing accurate delivery information when placing an order. If you discover an error in your delivery address, contact us as soon as possible at support@beautys.com.au. We will attempt to assist where reasonably possible, but we cannot guarantee that an address can be changed after an order has been processed or dispatched. Additional shipping charges may apply if an order needs to be resent because incorrect or incomplete delivery information was supplied. This does not affect any rights you may have where an error was caused by Beautys.

Returns, Refunds and Consumer Guarantees

Our products come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies. You may be entitled to a repair, replacement, refund or other remedy where required by Australian Consumer Law, including where goods fail to meet an applicable consumer guarantee. Beautys does not provide refunds or exchanges simply because a customer changes their mind, chooses the wrong fragrance, decides they do not like a fragrance, or no longer wants the product, except where we expressly agree otherwise. Damaged, Faulty or Incorrect Products

If you receive a product that is damaged, faulty or different from what you ordered, please contact us at support@beautys.com.au. Please include your order details and information about the issue. We may reasonably request photographs or other information to help us assess the problem. Where Australian Consumer Law provides you with a remedy, we will provide the applicable remedy in accordance with the law.

Product Use and Safety

Customers should use Beautys products according to the directions and warnings provided with the product. Do not use a product if you know you are allergic or sensitive to one of its ingredients. Discontinue use if irritation or an adverse reaction occurs and seek appropriate medical advice where necessary. Fragrance and cosmetic products should be kept away from children where appropriate and should not be ingested. Flammable products should be kept away from flames, ignition sources and excessive heat.

Intellectual Property

Unless otherwise stated, the Beautys website and its original content — including the Beautys name, branding, product photography, graphics, written content, product descriptions and website materials — are owned by or licensed to Beautys. You may not reproduce, distribute, modify, commercially exploit or republish our original content without permission except where permitted by law. References to third-party brands, product names or trademarks do not give Beautys ownership of those third-party intellectual property rights.

Reviews and Customer Content

If you submit a product review, photograph, comment or other content to Beautys, you confirm that you have the right to submit that material and that it does not unlawfully infringe another person's rights. Reviews must reflect genuine experiences and must not contain unlawful, abusive, fraudulent or misleading material. We may moderate or remove content where reasonably necessary, subject to applicable law.

Website Availability

We aim to keep our website available and functioning correctly, but we cannot guarantee uninterrupted access. The website may occasionally be unavailable because of maintenance, technical problems, updates or circumstances beyond our reasonable control. We may change or update website functionality from time to time.

Third-Party Services and Links

Our website may contain links to third-party websites or use services provided by third parties, including payment, delivery, analytics and other technology providers. Beautys does not control third-party websites and is not responsible for their independent content, availability, security or privacy practices.

Liability

To the maximum extent permitted by law, Beautys is not responsible for indirect or consequential loss arising from use of our website or products where such liability may lawfully be excluded. However, nothing in these Terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded or restricted under the Australian Consumer Law or other applicable legislation. Where liability may lawfully be limited, any limitation will apply only to the extent permitted by law.

Privacy

Your use of the Beautys website is also subject to our Privacy Policy, which explains how we collect, use and handle personal information.

Changes to These Terms

We may update these Terms from time to time to reflect changes to our website, products, business practices or legal obligations. The current version will be published on our website with its most recent update date. Changes will not retrospectively remove rights you already have in relation to completed purchases.

Governing Law

These Terms are governed by the laws applicable in Tasmania, Australia, and applicable Commonwealth laws. Nothing in this section limits any rights you may have under applicable Australian consumer protection legislation.
